Code of Conduct for registered migration agents

Migration Hub registered agents are bound by the official Code of Conduct for registered migration agents prescribed under Australian migration law.

Registered migration agents must comply with the Code of Conduct for registered migration agents. The instrument published on the Migration Hub site is the Code current from 1 March 2022 (official OMARA / Department publication).

We do not replace the full Code text here. Clients should review the complete official Code. Key themes include professional and ethical conduct, duties to Australia’s immigration system, the agent–client relationship, service agreements, fees and client money, confidentiality and record keeping.

Core themes in the Code

  • General duties to act professionally, ethically and with respect; not make false or misleading statements.
  • Duties relating to Australia’s immigration system, including complying with migration law and not giving futile assistance.
  • Practice management duties, including MARN display, professional indemnity insurance and notifying the Authority of relevant changes.
  • Agent–client relationship: conflicts, confidentiality, consumer guide, progress updates and service agreements.
  • Fees, disbursements, invoices, client money handling and refunds.
